brazil supreme court sets november 3 betting ban hearing

Operators, football clubs and government bodies will argue their positions on Brazil’s betting ban before the Supreme Federal Court (STF) on November 3, at a public hearing on Provisional Measure (MP) 1.394/2026.

The MP prohibits fixed-odds betting and allows sector licenses to be terminated. The hearing forms part of Direct Action of Unconstitutionality (ADI) 8027, filed by the National Association of Games and Lotteries (ANJL) and handled by Justice Luiz Fux. ANJL wants the measure suspended immediately and later declared unconstitutional, and has asked the court to confirm that the existing fixed-odds betting laws are valid. ADIs 8,024, 8,028 and 8,035 challenge the same MP. The session was requested by the AGU, which argued that evidence gathered since a November 2024 hearing on challenges to Betting Law 14.790/2023, along with the new MP, justified reopening the debate.

Fux has published the running order. He opens at 10am in the Second Chamber’s session room. Six clubs follow:

  • Flamengo
  • Fluminense
  • Botafogo
  • Cruzeiro
  • São Paulo
  • Corinthians

The Brazilian Football Confederation (CBF) and the Brazilian Olympic Committee (COB) speak after the clubs. In the afternoon, the Attorney General’s Office (AGU) goes first, then the Finance and Sports ministries. ANJL and the Brazilian Institute of Responsible Gaming (IBJR) speak between 3pm and 3:20pm, and the International Gaming Association closes at around 5pm.

Each of the 28 entities has 10 minutes and up to two representatives. The hearing will be broadcast on TV Justiça, Rádio Justiça and the STF’s YouTube channel.
